We have an active presence across all courts both in Belfast and throughout Northern Ireland and recently represented a client in a matter brought before the Supreme Court of the United Kingdom. We are mindful of the fact that litigation can be a stressful and often daunting experience for clients and increasingly we have had success in resolving disputes in a timely manner before litigation has commenced through the Law Society Mediation Scheme.

Our litigation team represents commercial and private clients in a broad range of areas including:

  • Matrimonial advice and have represented many clients over the years in securing a fair distribution of assets over the course of divorce proceedings 

Insolvency: we advise directors of insolvent companies or individuals and firms who have concerns regarding their solvency and regularly advise insolvency practitioners on both individual and corporate insolvency matters including:

  • Review of bank security documentation
  • The appointment of receivers and insolvency practitioners and their powers 
  • IVAs and CVAs
  • Disposal and realisation of assets by consent or enforcement
  • Duties of insolvency practitioners in office

Debt Recovery: we undertake regular debt recovery work on behalf of commercial clients including:

  • Instigating debt recovery proceedings to obtain judgment followed by, if necessary, insolvency proceedings 
  • Instigating repossession of property proceedings on behalf of banks, other secured lenders and landlords
  • Bringing enforcement proceedings via the Enforcement of Judgments Office 
  • Providing general advice to creditors when faced with debtor insolvency situations whether in respect of liquidation, bankruptcy, administration, CVAs or IVAs 

Consumer Rights: we regularly advise clients about protecting their consumer rights, this includes:

  • Rights arising under the Consumer Credit Acts 1974 and 2006, Sale of Goods Act 1979, Unfair Contract Terms Act 1977, Supply of Goods and Services Act 1982, Unfair Terms in Consumer Contracts Regulations 1999 and Consumer Protection (Distance Selling) Regulations 2000
  • Breach of privacy rights under the Data Protection Act 1998
  • Unsolicited marketing in breach of the provisions of the Privacy and Electronic (EC Directive) Regulations 2003
  • Mis-sold Payment Protection Insurance policies
  • Loss arising from cancelled package holidays and delayed or cancelled flights under Regulation EC261/2004
